Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the myshop.au website, applications, and services (the “Service”), operated by myshop.au (“myshop.au”, “we”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use the Service, and you must be able to form a binding contract. If you use myshop.au on behalf of a business, you confirm you are authorized to bind that business to these Terms.

2. The Service

myshop.au provides tools to create and run an online shop — building a storefront, listing products, accepting orders, taking payments, and managing customers and fulfilment. The Service is provided on an “as is” and “as available” basis. We may add, change, or remove features at any time.

3. Your account

Some features require an account, which you may create with an email and password or via Google. You are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.

4. Your content and licence

You retain all ownership of the shop content, product listings, images, text, and branding you submit (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and adapt Your Content solely to operate the Service — including publishing your storefront, showing your products to shoppers, and generating the outputs you request.

You represent that you own or have the rights to Your Content, that your listings are accurate and not misleading, and that selling your products and using Your Content does not violate any law or third-party rights.

5. Running your shop (merchant responsibilities)

You are the seller and merchant of record for your shop. You are solely responsible for:

  • the accuracy of your listings, pricing, stock, and shipping information;
  • fulfilling orders, providing customer service, and honouring your own store policies (returns, refunds, exchanges, and delivery);
  • collecting and remitting any applicable taxes and complying with consumer-protection, product-safety, labelling, and e-commerce laws in the places you sell;
  • handling your customers' personal data lawfully and publishing your own store privacy terms where required.

No outcome guarantee. We provide the tools to sell online, but we do not guarantee any level of traffic, sales, or revenue. The Service is a platform, not a sales or marketing service.

6. Acceptable use and prohibited products

You agree not to use the Service to:

  • sell illegal, counterfeit, stolen, or recalled goods, or items you do not have the right to sell;
  • sell restricted or high-risk items where prohibited — including weapons, illicit drugs, prescription medicines, tobacco or vaping products to minors, live animals, or adult material — except where expressly permitted and fully compliant with law;
  • engage in fraud, deceptive pricing, or sell products that infringe others' intellectual-property rights;
  • upload malware or content that is unlawful or harmful;
  • scrape, reverse-engineer, resell, or attempt to circumvent limits, security, or access controls, or use the Service to build a competing product.

7. Payments, payouts, and fees

Subscription plans are billed in advance on a recurring basis (monthly or annually) and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period, and access continues until then. Fees are stated at checkout and may change with notice for future periods.

Payments from your customers are processed by our third-party payment provider, which may require you to accept its terms and complete verification before receiving payouts. You are responsible for refunds and chargebacks to your customers. Where you have a statutory right of withdrawal or cooling-off (for example under EU/UK consumer law) or guarantees under the Australian Consumer Law, nothing in these Terms limits those rights. We do not store full card details.

8. Intellectual property

The Service, including its software, design, templates, and branding, is owned by myshop.au or its licensors and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or other brand features. Your shop and the content you create remain yours.

9. Third-party services

The Service relies on third parties (for example, our payment processor, authentication provider, hosting, and email providers). Your use of those features may be subject to their terms, and we are not responsible for third-party services.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties or consumer guarantees (including under the Australian Consumer Law); those rights are not excluded and apply to the extent they are mandatory.

11. Limitation of liability

To the maximum extent permitted by law, myshop.au and its suppliers will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, sales, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or AUD $100. Nothing in these Terms excludes liability that cannot be excluded by law, including under mandatory consumer-protection laws.

12. Indemnification

You agree to indemnify and hold myshop.au harmless from claims, damages, and costs arising from Your Content, the products you sell, your use of the Service, your dealings with your customers, or your breach of these Terms, except to the extent caused by us.

13. Termination

You may stop using the Service and close your shop at any time. We may suspend or terminate access if you breach these Terms, sell prohibited products, or to protect the Service, your customers, or other users. On termination, the licences you grant survive only as needed to comply with law, complete in-progress orders, and operate backups, and the sections that by their nature should survive will survive.

14. Governing law and disputes

These Terms are governed by the laws of Australia, without regard to conflict-of-law rules, and you submit to the non-exclusive jurisdiction of the Australian courts. If you are a consumer, you may also have rights to bring proceedings in your country of residence, and mandatory local consumer-protection laws continue to apply.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email where appropriate. Your continued use after changes take effect constitutes acceptance.
